She also concluded that the police response would have been quicker and more co-ordinated if one police agency had jurisdiction over Coquitlam, where Mr. Pickton’s farm was, and the Downtown Eastside. It was easy for Coquitlam RCMP to investigate other violent crimes they felt had priority, Deputy Chief Evans wrote. Also, the Vancouver force pursued leads but did not investigate Mr. Pickton because it deferred to the RCMP. … A clerk at the Vancouver police station who took reports of missing persons, Sandy Cameron, raised concerns in 1998 about the increasing number of women disappearing from the Downtown Eastside. .. Writing about a meeting in Sept. 22, 1998, Deputy Chief Evans wrote that, according to Vancouver police detective inspector Kim Rossmo, Inspector Fred Biddlecombe “basically threw a hissy fit or a small-scale temper tantrum . . . he said there is no serial killer.” … Deputy Chief Evans described Insp. Biddlecombe’s conduct at the meeting as unprofessional. He did not recognize the seriousness of the issue, she wrote. Deputy Chief Evans also criticized Inspector Gary Greer, Deputy Chief Brian McGuinness, Chief Terry Blythe and Chief Bruce Chambers, all of the Vancouver force, who she says did not pay close enough attention to the case. She also was critical of several RCMP officers, including for Chief Superintendent Gary Bass, who she said should have acted on information that he had received.”

“In 1972, Mr. W.L. (Lou) Hatton, Director of Communications System Research and Development proposed that CRC undertake a project based on the concept of government laboratories fostering selected areas of computer/communications technology in Canadian industry.The objectives of the project were: To develop a computer based data communication system for mobile units, using radio links. To foster the development and use of advanced communications systems of value to Canadian users, specifically, the use of mobile radio links for data transmission. To provide information of use in the management of radio spectrum and in development of standards. To develop technology which may be transferred to industry, to support the development of the Canadian communications industry. The project was begun by making several studies to determine the capabilities of the Canadian electronics industry, the user needs and market situation, standards, and the extent and sophistication of technology in use. A market study conducted under contract by Woods, Gordon and Company identified mobile radio data terminals as one of the best areas to address. This choice was doubly appropriate because the department’s mandate to manage the use of the spectrum requires an intimate knowledge of developing communications technologies and because CRC had existing expertise in radio communications. In October 1974, a proposal was reached with the RCMP. In January 1977, a project was launched to develop a system for the Vancouver police department. In January 1979, the mobile radio data system was officially turned over to the Vancouver police force. The Mobile Radio Data System (MRDS) is a computer based, data communication system for mobile units using radio links. The user (one of a fleet of mobile units) can report his position and status to and/or request information from a central control facility by using a specially designed computer terminal located in the mobile unit. In October 1974, DOC approached the RCMP who agreed with a proposal to cooperate in a joint project to specify, design and develop a modular radio communications system which would satisfy the major requirements of the Canadian Police Forces. Once expertise was established in the development of the police communication system, the technology was to be transferred to industry for police and non-police users. The design and development work for the demonstration system was done by Canadian industry. Early in 1975, industry was briefed on the program which included a requirement that the selected contractor commit to entering into the mobile radio data systems business. MacDonald, Dettwiler and Associates (MDA) won the Phase I contract to develop detailed systems specifications and trial plans. This contract indicated that a mobile radio data system supported by all the latest computer aids was beyond both the financial means and the practical requirements of most police forces. Consequently, a smaller system was selected for implementation and installation as a test case. The Vancouver Police Force indicated an interest. An agreement was reached between DOC, the RCMP and the City of Vancouver, wherein the city agreed to pay for all hardware components of an operational system with the federal agencies paying for the development work. In January 1977, the design for the system was competed and a mock-up terminal was prepared. The Phase II work was divided into two contracts. Part A was intended to produce an operational system for the Vancouver Police Force. This system was to be available for immediate use, once completed and tested. Part B was intended to produce a completely Canadian built terminal and system, designed to meet police needs and those of the transportation sector. In the case of the police, this included the capability to access the RCMP data base from their vehicles and the capability for headquarters messages to the field force. In 1978, MacDonald, Dettwiler and Associates (MDA) in consultation with Ventures West Ltd., were instrumental in creating International Mobile Data Incorporated. MDA transferred the necessary technology and personnel to IMDI to produce and market the system. The more advanced system included a microprocessor-based controller, the mobile terminals and the base station controller. Based on the success of the trial system, the Vancouver Police Force bought a complete set of the Canadian-manufactured terminals for their fleet. The new system went into service in the Vancouver police department in January 1979. With the transfer of the technology to Canadian industry, the project was considered a success. Post-installation evaluation of the system was undertaken by Cantel Engineering Associates and Simon Fraser University [with Nancy Campbell’s alleged Settlement associates embedded (?) in the Pickton pig farm family].”

E-Comm was established under the Emergency Communications Corporations Act in 1997. As a cost-recovery business corporation, it is owned by stakeeholders made up of all the agencies that use its service, which include municipalities, police boards, provincial and federal government agencies, and crown corporations. E-Comm is located at 3301 East Pender Street, across from Pacific National Exhibition. The E-Comm building is a post-disaster facility, meaning designed to resist a major earthquake. The Observer, Sunday 12 March 2006 Article history The scandal that shook the British establishment began in implausibly sun-drenched circumstances. Late on the evening of Saturday, 8 July, 1961, in a sweltering minor heatwave, Viscount Astor took a stroll through the grounds of his sumptuous Buckinghamshire mansion, Cliveden, accompanied by a gaggle of friends who had been dining with him that evening. As they meandered down towards the swimming pool, gossiping over their brandy and cigars, they heard the sound of splashing and laughter. Then, as Astor and his nearest guest turned the corner, they saw a naked girl rushing from the pool to fetch her towel from the bushes. It was the first time John Profumo, the Secretary of State for War, set eyes on Christine Keeler, a meeting that was to change the course of history. Even today Profumo’s affair with Christine Keeler is widely misunderstood. His monastic silence about the case means that, unusually for a retired politician, he took his secrets to the grave, and we might never know what he really made of the woman with whom he will be forever associated.

A former showgirl from the gravel pits of Wraysbury in Berkshire, Keeler was just 19 and was staying on the estate with her friend, patron and (some said) pimp, the society osteopath Stephen Ward. Her lovers included a Soviet naval attaché, Eugene Ivanov, who also visited Cliveden that weekend and even had a swimming race with Profumo on the Sunday afternoon .. Ivanov was actually a Soviet spy under MI5 surveillance and the security service had been hoping to use Stephen Ward to persuade him to defect. In August 1961, therefore, the Cabinet Secretary called Profumo in and gently suggested that he back away from the entire business. Since the affair was merely a casual diversion, Profumo immediately scribbled an affectionate note – the infamous ‘Darling’ letter that later returned to haunt him – to cancel their next meeting. His affair with Keeler had lasted exactly a month and a day, and there the whole matter, apparently so inconsequential, might well have ended .. As the head of MI5 told Prime Minister Harold Macmillan, Ward was ‘a pimp, not a spy’. Profumo and Ivanov did not share Keeler, as was often reported, since she had stopped seeing the Russian before the affair began. And it was ridiculous to imagine Keeler as an intermediary or informer; she was basically a glorified call-girl, hardly likely to remember details of nuclear technology or Profumo’s Nato responsibilities .. One of the few papers that did not lose its head, in fact, was this one, yet there was more to The Observer’s decorum than met the eye. When rumours of Profumo’s affair leaked out in the first months of 1963, The Observer, like most papers, hesitated to print them. In part this was because David Astor, the newspaper’s legendary campaigning editor, was working in a more tactful age, when politicians’ private lives rarely made it into the press. But it surely also owed something to his family connections with the case. Bill Astor, who had introduced the two lovers at the poolside party at the family seat, had a raffish reputation of his own – and he was David’s elder brother.

Bill and David Astor had grown up during the days of the ‘Cliveden Set’, an irregular gathering of politicians and partygoers who in the 1930s fervently backed appeasement of the Nazis. David’s controversial politics, which encompassed opposition to apartheid and the death penalty, were very different from his brother’s Toryism. But it was hardly surprising that, when memories of the Cliveden Set were still raw, he never approached his brother for an exclusive. Instead, the story was left to Private Eye and the tabloids, with sensational results. .. Just like the sleaze scandals of the John Major years, the affair seemed to sum up everything that was wrong with the Tory hegemony of the day .. The significance of the Profumo affair, therefore, was that it brought to a head existing anxieties that had been simmering away for years beneath the apparently untroubled surface of the affluent society. Instead of marking a radical break with the past, as is often claimed, it gorged parasitically on the discontents of the Macmillan era. The bestselling authors of the day – Ian Fleming, Len Deighton and John le Carré – could not have dreamt up a story more likely to strike a chord with the general public.

The involvement of Ivanov gave the story a nice twist of Cold War paranoia, which went down perfectly in the year Bondmania reached its peak, while Keeler’s involvement with a string of West Indian crooks played into the hands of those people alarmed by rising immigration. Another member of her circle, the rapacious slum landlord Peter Rachman, had himself become a symbol of the greed and materialism of the affluent society, adding more spice to the mix .. There were no happy endings. Ivanov was recalled to Moscow, where his wife abandoned him and he turned to drink. Ward, on trial for living off the earnings of prostitutes, killed himself with an overdose of barbiturates. Bill Astor, accused of consorting with teenagers himself, was shunned by polite society. And Keeler drifted from one broken marriage to the next, ending up living alone in a council flat under an assumed name. Davies sat on Vancouver city council during Campbell’s stint as mayor and police board chair from 1986 to 1993, around the time that women began disappearing from the Downtown Eastside. “It doesn’t put him in a conflict of interest,” the Vancouver East MP told the Straight by phone. “He’s the premier. He’s in a different role. A lot more information has come forward since when he was mayor. Back in those days, originally the call was for a special task force, and that was turned down many, many times when I was on council and such. But no, I don’t think he’s in a conflict. He’s the premier and he’s got to uphold the public interest.” Davies is urging her long-time political opponent to call a public inquiry to probe the actions of the Vancouver Police Department and the RCMP in response to the disappearances and murders of the women. (She has asked that Prime Minister Stephen Harper do the same.) On July 30, Mike Farnsworth, the B.C. NDP’s critic for the solicitor general and public safety, also told the Straight he is not concerned that Campbell’s previous role as chair may pose a problem now.

Davies said, “He [Campbell] has got to recognize the incredible trauma that has happened in this province and in Canada due to the missing women. He has to make that decision as the premier, and whatever he may have thought as mayor and chief of the police board, he is now in a different role, and he has got to make that decision as premier, and he must make it.” Campbell has yet to issue a statement on whether or not there will be a public inquiry. This disgusts Davies, who has long claimed that it is only because the women were sex workers and predominantly aboriginal that justice has been denied and delayed. “Everybody in society has failed these women,” Davies said.”

A recent judgment handed down in England has wider application, writes CAROL COULTER

THE PRESIDENT of the family division of the high court of England and Wales has just ruled that extensive information concerning a family law dispute, including the names of the two parents in the case, be published. Sir Nicholas Wall did so to counter misinformation about the case being broadcast on the internet.

The case was taken by Doncaster Metropolitan Borough Council, which sought the publication of information about the case following a campaign of misinformation on the internet and in e-mails sent by the mother and a group of her supporters.

The misinformation, centring on the unfounded claim that the father had sexually abused their child, was circulated among parents in the child’s school and to the father’s employer and threatened the welfare of the child, who was living with her father.

The case was brought by the council against Victoria Haigh, with her former husband, David Tune, as second respondent. The child, who was represented by her children’s guardian, was known only as X.

The child is now almost eight years old and is living with her father, though formally under the care of the local authority following a number of legal proceedings arising from the separation of her parents and a subsequent custody battle.

The couple, both of whom had been successful sportspeople, married in 2003 and had a daughter. However, they separated in 2005 when Mr Tune left the family home. Initially he had extensive contact with his daughter, but in the spring of 2006 Ms Haigh stopped the contact taking place.

Despite a number of court orders seeking to reinstate contact, she continued to resist this and at one court hearing assaulted the father.

At that hearing she also made the first allegation against him of sexual assault of their daughter to Doncaster social services, and suspended contact. A number of such allegations followed, each of which was investigated by the social services, and each of them resulting in the suspension of contact or its taking place only under supervision.

After many investigations, including four medical examinations of the child, the case came before the family court, where Judge Robertshaw found Ms Haigh had coached her daughter into repeating the allegations she had first made. He said these allegations were false, made to obstruct contact between the child and her father.

He ruled the child should live with her grandmother and have contact with both parents, warning the court might ultimately have to rule she lived with the parent who would permit contact with the other parent. The mother did not appeal this ruling.

In a subsequent hearing about where the child should live, before Judge Jones, the judge ordered a full psychological assessment of Ms Haigh and found she had continued to seek to manipulate her daughter and place her own needs as the priority. He ruled it would be contrary to X’s best interests for her to live with her mother as she would suffer psychological harm in her care, and ruled she should live with her father.

He also recorded his impression that Ms Haigh needed “professional help”. Social services considered it was still very important for the child to have contact with her mother, but that in the circumstances this could only take place with a social worker present.

Ms Haigh rejected this and decided she would not see her daughter at all in these circumstances, despite the fact the child had expressed a wish to see her mother.

All these proceedings had taken place in private, in accordance with English law on child care cases.

Ms Haigh’s attention then turned towards a media and internet-based campaign. According to the president’s judgment, “She recruited a number of individuals to assist her in that campaign and there is much information on the internet about X which is in breach of the injunctive remedies the court has put in place in its concern to protect X’s privacy.”

The mother then e-mailed the school with a document styled as a letter to X in which she said: “I am famous again darling, but this time it is not because I am a model or racehorse trainer . . . I have been in over 7 newspapers and I am going to be doing television programmes very soon.”

She also contacted her former husband’s employers through the company’s website and through the personal Facebook accounts of members of staff, alleging Mr Tune was a paedophile and a rapist, and also alleging a conspiracy among the courts, the police, all the professionals in the case and the judiciary.

Sir Nicholas described as “most disturbing” the fact Ms Haigh had caused profound difficulties for the child at her school. Most of the parents of the children there were aware of the allegations on the internet, and they had been e-mailed by the mother. The school told the court attempting to protect the child from this had caused difficulties of “monumental proportions”.

“The extracts from X’s police interviews contain the false allegations,” Sir Nicholas said. “There are those who will read it for their own sexual gratification, victimising X in the process. The mother seems to be entirely unable to understand or empathise with the consequences to X of these actions.

“Such is the extent of the false, unauthorised and tendentious material now placed in the public domain that the local authority, who would otherwise be striving to protect the privacy of X, have concluded that the balance has shifted and that in this particular case, X’s best interest is served by the true facts being made available,” he said.

He therefore ruled that an extensive account of the facts, summarised above, be published.

While this is an English case, given the nature of the internet, it is only a matter of time before a similar case arises in Ireland.

AT THE ROYAL COURT OF JUSTICE  4 10 11

At the Royal Court of Justice on the 4th Oct. 2011 it took police intervention in the form of an order to the court for the baby’s medical report to be shown which hitherto the council had witheld from everybody, including the childs parents – seeing their baby’s medical report on publication was their legal right, but this was denied until this hearing, and it is clear to see why. For the report showed that there were NO ALLEGED DRUGS IN THE BABIES BODY, contrary to the councils allegations which ensured an Emergency Protection Order was issued, with an Interim Care Order issued directly after which successfully removed the baby from her parents. The baby was taken on the strength that she was showing “symptoms” of being administered drugs by her parents, who were subsequently held for 27 hours in police custody on the strength of this and treated with utter contempt whilst there, with racist slurs aimed at them by a certain officer which defies comprehension. Being falsely arrested is now becoming the norm for this couple.
The Musa parents will now hopefully be seeing their 4 children for the first time in 6 months, and the baby will hopefully be seen, who hasnt been since June 28, when she was taken via the Interim Care Order, based on no evidence whatsoever other than the councils ex-manager Peter Lee’s hearsay allegations of the baby showing “symptoms” of drugs being administered to her which are now completely disproven by the official R.O.A.R. report. Mr. Peter Lee has now left the employ of Haringey council and they are tight-lipped as to his whereabouts.

 The subject of the contact visits between the Musa parents and their children is a subject in itself where outrageous irregularities have occurred over the months which should be investigated properly – the Musa parents have gone on over 40 contact visits - travelling across London to a different county to see their children – which has been a complete waste of time. Either some of the children have not been brought or all of them havent for them to visit – if the contact centre has been open at all, as often theyve spent hours getting to the place only for to be shut with noone around. One would have thought they could have been informed before they set out whether it was worth them travelling to the contact centre if going there was going to be a waste of time and money, but no -  the Haringey council doesnt bother informing them, thus causing unnecessary distress to the parents as well as financial hardship. The parents are entitled to have their fares paid for contact visit travels – but this has been denied by the council for months and the parents have forked out what has amounted to small fortune travelling back and forth to the contact centre often for nothing. At the eviction hearing appeal at Edmonton court in August I witnessed Gloria Musa trying to discuss with the judge HHJ Morley the very subject of the numerous dishonoured travel fees but this judge was having none of it and he brushed the subject aside with an indifference that surprised me. Gloria was trying to show him scores of null and void travel tickets allocated to her by Haringey council – which werent worth the card they were printed on – in an effort to explain the situation. He couldnt have cared less. This occurred at the end of the very one-sided hearing, and their 40 minutes court time was up, and the £170 theyed paid for the hearing had been spent and it was time for them to go. The appeal against their eviction from their home had not been upheld, despite many contractual irregularities in play on the flat provided by Haringey council, and they had 3 days to find somewhere else to live and move all their belongings out. Never have I felt such sympathy for a couple, who had not only had their 6 children stolen from them by the most criminal methods, but now they were without anywhere to live and were in effect homeless.

 Regarding the contact visit travel tickets on one occasion the Musas were even fined £50 by British Transport officials for travelling without a valid ticket – unbeknownst to them the tickets they had been given were fake. On another occasion where the travel tickets issued to her were null and void Gloria had no choice but to get a cab there and back to the venue 50 miles away costing an overall fare of over £100 –  she was heavily pregnant at the time and carrying many items for the children also and this was the only recourse. The council are fully aware about the travel ticket irregularities they have palmed off on this couple but of course nothing is ever done. The judge at the hearing wasnt interested either. They all need investigating as soon as possible to rid the taxpayer of this blight on our resources if these are examples of how they perform – and they most definatly are.

The shocking case of the removal of 6 children from this family just goes on and on. Various intimidatory techniques have been used,with attempts to force the parents and a supporter into to mental asylums in an attempt to silence them lest the horrific “can of worms” be opened too much. Charges of “conspiracy to kidnap children from Haringey council” have also been attempted, with the parents arrested, along with Maurice the erstwhile supporter and campaigner for them. The ridiculous charge might have borne fruit for these dubious authorities had any of the accused actually set eyes on the children or even had knowledge of their whereabouts, but no – one child, who well call “F” {due to injunctions} who has been sexually abused whilst in care, hasnt been seen for nearly 14 months since she told her father of the abuse on a contact visit. The other 4 children have not been seen for 6 months, and the baby, who was snatched with nothing near justifiable evidence, hasnt been seen since she was taken on June 27th. The children not being seen by their parents for such outrageous periods of time is highly illegal too.

Do the authorities think this case will simply “go away”? The  parents have actually been offered passports so they can disappear back to Africa – without their children. Who in their right mind at the council – where this ludicrous offer came from – could believe doting parents of 6 children would actually turn their backs on them and and return home to Africa without them never to be heard from again? Whosoever in this dubious council actually believes something like that could ever happen needs to see a specialist, and pretty quick. Maybe if the parents were in any way guilty of the ludicrous charges this council claims has happened then maybe they might just up and go, but these are seriously responsible parents who have done no wrong towards their children – or anybody else come to that – yet have been treated in the most horrific unjustifiable way. If the MPs and numerous other so-called “authority figures” would actually do their jobs and take seriously the scores of messages sent to them detailing the outrageous actions this family has had to suffer then maybe some headway could be achieved and the long sought for justice could begin to happen. But no – the shocking amounts of money certain individuals are receiving whilst milking the taxpayers purse whilst dealing with this case are so high it actually pays them to work together outside of the law.

Meanwhile supporter and campaigner Maurice Kirk sits in a prison cell refusing to leave because he knows no justice is about to be delivered his way in the court – hes having to use a video link to the court on the 5th so as the dubious judge can deal with this totally innocent man, whose been blackjacketed throughout the past 18 years for daring to know his Human Rights and act upon them and fight the insane injustices thrown his way by these corrupt characters with their totally over-the-top power. The cases – so unjust and immoral – go on and on, at our expense and these poor peoples pain, and that includes witnesses to the  case who have been hounded and persecuted for no reason whatsoever.

Abuse of Judicial power

At this late date, the individually itemized list of abuses and usurpation’s would require an encyclopedia of unconstitutional offenses to the Republic and there is no evidence to suggest that there remains even one legitimate honest courtroom in the country to which all evidence could be presented.

There is no Article or Amendment of the U.S. Constitution which the current leadership in Washington D.C. has not abused and/or usurped over the last three years.

As a result, the normal courses of action for redress may not be adequate to solve the problem today, as all three branches of the federal government are currently acting as one, all of them beyond the scope and power granted them by the Constitution, against the principles of freedom, liberty and self-governance, and at odds with the vast majority of citizens.

On 27th October, in a landmark hearing in an OPEN Court of Appeal, a disabled young woman who claims to have been repeatedly abused by a high-level paedophile ring during her childhood will be asking for permission to pursue justice and her human rights against her former abusers. She and her mother have been silenced by people in official positions using and abusing their powers of secrecy to shield those who commit these horrific crimes against the young and vulnerable. In her own words, in mounting this appeal, this young woman is “fighting to stop other children being hurt”, as well as silenced and intimidated, both by the powerful perverts perpetrating the abuse and by the SECRECY of the family court system seemingly backing them up.

The young woman, who cannot be named for legal reasons, may not have very much longer to live. She is already well-known both internationally and nationally and all eyes are on her. With the help of her many friends and supporters, despite her disability she is determined to achieve justice. She and her mother are making this stance in the Court of Appeal for their inalienable human rights, which have been denied them by the malicious and unlawful actions of their local authorities to shut them up. The Family Division of the UK Royal Courts of Justice (and its equivalent in Commonwealth countries) is known for its SECRECY and not for transparency nor for its compassion in listening to the voices and anguish of children/vulnerable adul…ts and their families. These are then sidelined by the courts who unlawfully force the appointment of the Official Solicitor under the guise of protecting the child/vulnerable adult. On the morning of 9/11 a variety of layered military operational exercises were underway simultaneously. It resulted in an environment where command and control were made difficult due to the numerous federal agencies overseeing their individual exercises and therefore when the exercises where supplanted by the terror attacks the US was delayed in fielding a focused defense of American airspace. The entire continuity of government exercise ( TOPOFF ) was turned real and the real response was slow to develop and insufficient to obstruct the progress of three of the four hijacked flying vehicles which reached their targets on the morning of 9/11. In the ensuing 122 months very little has changed regarding the ability of a Commander in Chief to deploy force to defend America from an attack of the nature of the exercise turned lethal in September of 2001. Perhaps in the run up to the election of 2012 prospective candidates for high federal office will be able to speak with authority on what actually occurred on the morning of 11 September, 2001, and why we, the American People, should have confidence that our government officials could block a False Flag Terror event involving tactical nuclear devices if it were to occur in the 96 hour threat window of 0700 7 November, 2011 to 0700 11 November, 2011. Canada’s Finance Minister Reacts to U.S. Extraterritorial FATCA and FBAR Requirements

Federal Minister of Finance Jim Flaherty has sent a letter to several major U.S. newspapers expressing Canada’s concerns about the far-reaching implications of the extraterritorial U.S. Foreign Account Tax Compliance Act (FATCA) and the “nerve-wracking” effect that the Foreign Bank Account Report (FBAR) reporting rules has on Canadians. The letter, dated September 16, 2011, criticizes the broadness of the U.S. rules that would essentially cause Canadian banks to become “extensions” of the Internal Revenue Service (IRS). Flaherty also notes that the rules raise privacy concerns for Canadians who may not be aware that they needed to file U.S. tax returns.

It is unclear what effect this Canadian political pressure may have on the U.S. administration of the reporting requirements and penalty regime that apply to Canadian residents.

The letter comes shortly after the deadline for the IRS’s second Offshore Voluntary Disclosure Initiative, which allowed individuals to bring offshore funds back into the U.S. tax system and helped those with undisclosed income from offshore accounts resolve their U.S. federal income tax liabilities.

The letter reads as follows:

Canada and the United States are neighbors and have long been the closest of friends.  We share a common border and we share many common values.

One of those values is fighting tax evasion. We believe in fair tax systems where everybody pays their share.

Many Canadians, however, have become concerned about the impact of a proposed piece of American tax legislation – the Foreign Account Tax Compliance Act, or FATCA.

I share their concern.

We appreciate efforts to combat tax evasion. In fact, our two jurisdictions co-operate to prevent it. But FATCA has far-reaching extraterritorial implications. It would turn Canadian banks into extensions of the IRS and would raise significant privacy concerns for Canadians.

To be clear, Canada respects the sovereign right of the United States to determine its own tax legislation and its efforts to combat tax evasion – the underlying objective of FATCA.

But put frankly, Canada is not a tax haven. People do not flock to Canada to avoid paying taxes. In addition, we have existing ways of addressing these issues with the United States through our Bilateral Tax Information Exchange Agreement. As I said, we share the same goal of fighting tax evasion and we already have a system that works.

To rigidly impose FATCA on our citizens and financial institutions would not accomplish anything except waste resources on all sides.

Another issue, this one affecting more directly the large numbers of dual U.S.- Canadian citizens and their relatives living in Canada, is the IRS’s Foreign Bank Account Report (FBAR) filing requirements.

Most of these Canadian citizens, many with only distant links to the United States, have a very limited knowledge of their tax reporting obligations to the United States. These are honest and law-abiding people, including many senior citizens now caught in a nerve-wracking situation. Moreover, because they work and pay taxes in Canada, they generally do not owe any taxes in the United States in any event. Their only transgression is failing to file the IRS paperwork they were never aware they were required to file.

These people are not the targets of a crackdown on tax evasion. These are not high rollers with offshore bank accounts. These are people who have made innocent errors of omission that deserve to be looked upon with leniency.

Rather, these people are typically hard-working citizens of our two great countries.

Faced with the knowledge that they do have an obligation to file U.S. tax returns (even if they most often do not actually owe any taxes) they want to do the right thing.

But the threat of prohibitive fines for simply failing to file a return they were unaware they had to file, is a frightening prospect that is causing unnecessary stress and fear among law abiding hardworking dual citizens.

We support efforts to crack down on legitimate tax evasion. These measures, however, do not achieve that goal.
